DB InnerFit Membership Agreement

This Membership Agreement (“Agreement”) is entered into between DB Innerfit, hereinafter referred to as the “Gym,” and the undersigned individual, hereinafter referred to as the “Member” (or the “Parent/Guardian” if the Member is a minor). Membership Fees
  • The Member has opted for the Monthly membership and has to pay the monthly fee (hereinafter referred to as “Fee”) to avail the facilities of the Gym.
  • Monthly memberships are paid in advance monthly, on the calendar date the membership has started, for the following month.
  • Failure to pay fees within 3 days may result in suspension or termination of membership.
  • Amounts not paid in full within 30 days of their due date will be subject to a late payment charge of 2% of the unpaid amount per month or $2.00, whichever is greater.
  • Recurring payments and Annual Enhancement Fees, other than those paid by pre-authorized credit card charge, are subject to an additional $5.00 service fee per payment plus applicable taxes.
Personal Information and Privacy
  • The Provider will collect and store personal information in accordance with applicable privacy laws and regulations.
Fitness/Consulting Services
  • The fitness or consulting services provided under this Agreement, if applicable, are provided as a program by DB Innerfit, and are not the services of any individual trainer.
  • DB Innerfit also reserves the right to sell training, class packages, and memberships at different rates or terms than set forth in this Agreement.
  • Member understands results are not guaranteed and are dependent on several factors including my adherence to the diet and exercise program as recommended, if applicable.
  • Member understands that results of the programs offered will vary from person to person and are neither predictable nor controllable by DB Innerfit or any of its agents or employees.
  • DB Innerfit or any of its agents or employees are not licensed dietitians or nutritional specialists. All information Member obtain will be directly from the consultant’s own experiences.
Member Access
  • This Agreement entitles the Member to access the Gym’s facilities (hereinafter referred to as “Facilities”) as long as the dues are paid in advance to the Gym.
Check-In
  • Members must check in at the Front Desk upon arrival, providing necessary identification and completing any required paperwork.
Rules and Responsibilities
  • The Member shall abide by all the safety guidelines and regulations as set forth by the Gym while using the facilities or equipment of the service.
  • The Member agrees that the Member shall abide by the Gym’s dress code at all times while in the facility.
  • Consumption of drugs, alcohol, tobacco, or similar addictive substances must be strictly prohibited at the fitness facility provided by the Gym.
  • Cell phones are not permitted in the cardio area. Photography and/or videography are not allowed anywhere in the Gym.
  • Breaking into fights that involve physical injury shall not be permitted at any cost and must result in either suspension or termination of membership.
  • Members are expected to update their membership status on a monthly or yearly basis.
  • Members must respect each other in all circumstances and should take care of the instruments or equipment after every use.
  • The Members shall wipe down all equipment after each use and re-rack the weights used.
  • Any violation of gym rules may result in suspension or termination of membership without a refund.
Cancellation and Refunds
  • Members may cancel their membership by providing written notice of 14 days prior to the next billing cycle.
  • No refunds will be provided for unused portions of the membership term.
Class Cancelation and Booking
  • Reserving Classes
  • Members are solely responsible for the booking and canceling of their classes.
  • Sign In
  • Members are required to enter their scheduled class no later than 5 minutes after the scheduled start time.
  • If a member does not enter their classroom by the specified time, it will be considered a no-show. In the event of a no-show, DB Innerfit reserves the right to assign the spot to another person on the waitlist. Additionally, a deduction from the member’s total number of classes will occur as a consequence of the no-show.
  • Cancellations
  • Reservations may be canceled without penalty by canceling up to 12 hours prior to the class start time.
  • Once the class is canceled within this time, the class will be returned to the client’s account, and the client will not be charged the cancellation fee.
  • Cancellations via electronic mail (email), Facebook messenger, Instagram or other social media, voice message, text message are not valid and the member will be charged.
  • The no-show and late-cancel fees apply to ALL clients equally regardless of status or special package pricing or membership level.
  • If you book multiple classes, or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy outlined above. DB Innerfit staff cannot be held responsible for accidental bookings by clients, double bookings, or double waitlisted classes made by members.
  • Late-cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings.
  • Waitlist
  • In the event a scheduled class is booked to capacity, you may place yourself on the waitlist for the class. If you add yourself to a wait list, YOU are solely responsible for managing your bookings and for canceling your classes within the bounds of the cancellation policy.
  • The system will auto-populate clients into class from the waitlist as soon as other clients with confirmed spots cancel, and class slots will be assigned as such.
  • DB Innerfit staff cannot move class slots for clients in classes that are completely full with waitlists.
Health and Safety
  • Members are responsible for ensuring they are in good health before participating in gym activities.
  • Members must inform Gym staff of any health conditions that may affect their ability to use gym facilities.
Credit Card on File Policy
  • Members may elect to keep a credit card on file.
  • By placing a card on file, the cardholder and account holder gives permission to the DB Innerfit staff to charge the card for any auto-debit packages and/or cancellation fees accrued in accordance with the DB Innerfit, cancellation policy detailed above.
Auto-Debit Policy
  • By enrolling in an auto-debit contract, you authorize DB Innerfit to, on a recurring basis, automatically charge the debit or credit card account you specified, for the monthly payments on your unlimited auto-debit plan associated with your account, on the billing due date. You understand and acknowledge that
  • DB Innerfit will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on your Membership Agreement and/or in connection with cancellation fees per the cancellation policy. DB Innerfit may discontinue processing of recurring charges if it is unable to secure funds from your debit/card due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information provided;
  • DB Innerfit booking system allows for booking through the week regardless of the billing date of your contract;
  • If you are booked in a class past the subsequent billing date, and your debit/credit card fails to bill properly, that you will be removed from any classes past the subsequent billing date and notified via electronic mail;
  • If you are removed from class due to the circumstances as described, it may not be possible to place you back into the class for which you were originally booked and that you will not be given any priority in waitlisted classes;
  • It is your responsibility to keep a current card on file with accurate billing information. DB Innerfit cannot be held responsible for errors in processing due to expired or inaccurate information.
Liability Waiver
  • The Member acknowledges and agrees that there are risks involved with any fitness and physical activity, the use of exercise equipment, and participation in an exercise program, and such risks may include the risk of serious bodily injury or death.
  • By signing this agreement, the Member knowingly and voluntarily assumes all risks of liability, loss, illness, death, or injury caused or arising out of any use of the Facilities or the participation in any activities by the Member.
Membership for Minors
  • If the Member is a minor, the undersigned Parent/Guardian acknowledges and agrees to all terms on behalf of the minor.
  • The Parent/Guardian is responsible for the minor’s compliance with gym rules and ensuring their safety.
Texts and Calls
  • We may offer you the ability to receive texts and calls in connection with our services. If you opt-in to receive texts and calls, you agree that DB InnerFit may send you reoccurring texts and calls (including prerecorded and/or by autodialer) to the phone number you provide for transactional and marketing purposes in accordance with the terms of your opt-in.
  • You can opt-out of receiving texts or calls to your phone number at any time by (i) for texts, contact us at [email protected] and specifying you want to opt-out of texts to your phone number; and (ii) for calls, requesting opt-out during any call you receive from us or contacting us as at [email protected] and specifying you want to opt-out of calls to your phone number.
  • We may send you a text confirming any opt-out by you and any such opt-out is limited to the phone number used and will not affect subsequent or separate subscriptions.
  • You understand that your consent is not required as a condition of purchase.
  • Standard message, data, and other fees may be charged by your carrier, and carriers may deduct charges from pre-paid amounts or data allowances, for which you are responsible. Not all phones and/or carriers are supported. Contact your carrier for further details. Additional terms may apply as set out in the terms of your opt-in.
Lost Goods
  • The Gym takes no responsibility for lost or stolen goods. Lost and found goods not claimed after 14 days will be donated to charity or thrown away.
Damages
  • The Member shall pay for any damages it incurs to the equipment or premises of the Gym, which results from the poor conduct of the Member or its guests.
Photo/Video Release
  • You hereby grant DB Innerfit, its representatives, employees, or agents the right to take photographs and video footage of you and your property while at DB Innerfit and to use and publish these photos or videos in print and/or electronically.
  • You agree that DB Innerfit may use photographs or video footage of you with or without your name for any lawful purpose, including for such purposes as publicity, illustration, advertising and web content.
Suspension and Termination
  • The Gym reserves the right to suspend or terminate this Contract for any violation of the terms, rules, or policies, or for non-payment of fees.
  • The Gym reserves the right to terminate or suspend a membership for any violation of this Agreement or the Gym’s rules.
  • The Member has the option to terminate this Agreement at any time. To avoid billing for the upcoming period, the Member must provide a cancellation notice at least 5 days before the scheduled billing date.
Member Conduct
  • DB Innerfit is committed to the health, safety, and welfare of each of its members and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior.
  • Members who do not observe DB Innerfit’s rules and regulations or who abuse equipment in any fashion will be asked to leave.
  • DB Innerfit has the right to judge behavior and respond accordingly. This right includes, but is not limited to termination of a membership without refund to any member engaging in unacceptable behavior.
  • The member shall pay for any damages to DB Innerfit property which results from the willful or negligent conduct of any member, member’s guest, or member’s dependent child.
  • Not all rules and regulations are listed in this agreement. DB Innerfit reserves the right to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by DB Innerfit.
Changes to Terms
  • The Gym reserves the right to modify the terms of this Agreement with notice to Members.
Governing Law
  • This Agreement is governed by the laws of Michigan.
